Are you a qualified lawyer with a current NZ practising certificate and two years criminal advocacy experience?
 
If so, New Zealand Police is looking for you in the role of Police Prosecutor.

OTHER REQUIREMENTS

Compulsory qualification: LLB and practising certificate for applicants who do not hold the Office of Constable.

Prosecutors may be required to work Saturday court on a rostered basis.

PURPOSE
 
Provides an effective, efficient and professional Police prosecution service in respect of all matters covered by the summary jurisdiction in accordance with the Solicitor General’s Prosecution Guidelines, including advocacy services in the Coroners Court and Liquor Licensing hearings.
 
KEY ACCOUNTABILITIES
 
1. Service Delivery
  • Consults with Officers in Charge and supervisors in relation to charge determination, sufficiency of evidence and criminal liability.
  • Ensures that the standard of prosecution files complies with the approved national standards and that sufficient evidence exists to proceed with prosecution.
  • Liaises with prosecution witnesses in respect of evidential and court process matters.
  • Makes decisions in relation to the appropriateness or otherwise of the charge/s laid and the sufficiency of evidence to prove the charge/s.
  • Identifies legal/prosecution risks and initiates appropriate remedial actions including, where appropriate, the substitution or withdrawal of criminal charges.
  • Negotiates with defence counsel in accordance with the Solicitor General’s Prosecution Guidelines in relation to charge determination.
  • Analyses criminal liability and develops prosecution strategy and tactics in relation to each case.
  • Provides appropriate advice, instruction, feedback, counselling and training in respect of the prosecution process and construction of prosecution files to district staff.
  • Provides timely direction and advice to the Judiciary on criminal legislation when called upon in court to do so.
  • Prosecutes at District Court and Youth Court through list courts, status hearings, defended hearings and depositions.
  • Advocates at Coroners Court, Liquor licensing applications and firearm revocation
  • hearings and other miscellaneous hearings as required.
  • Conducts legal research to strengthen prosecution case.
  • Researches and prepares detailed written legal submissions for presentation in court.
  • Coordinates prosecution files for appeal decisions by legal section.
  • Monitors and reports judicial comments, criticism and praise.
  • Meets police obligations under relevant legislation, including but not limited to police responsibilities to victims as required pursuant to the Victims Rights Act 2002.
  • Administers the diversion scheme as the diversion officer ensuring consultation occurs with O/C case, victims, and community based diversion/restorative justice coordinator.
 
2. Relationship Management
  • Maintains liaison and communication with all Police Prosecution Service [PPS] staff, district diversion officers, inquest office, legal advisers, police staff within the district and nationally.
  • Develops and maintains networks with the Judiciary, Crown solicitors, Ministry of Justice (Courts) staff, Child Youth & Family Services, law practitioners, Department of Corrections staff, Victim Support and community service organisations.
  • Identifies problems and produces solutions to issues within the prosecution process, uses discretion to address problems and provides appropriate feedback and advice to the O/C case and supervisors.
  • Maintains and promotes a positive relationship with media and other interest groups.
  • Provides appropriate feedback to the officer in charge of the PPS office.

Position is primarily based in Pukekohe and will be required to work in other locations in the Counties Manukau District (from time to time).
