Standards guide for commercial vehicle enforcement in New Zealand

POLICY STATEMENT
This Enforcement Standards Guide has been prepared by the Commercial Vehicle Investigation Unit (CVIU) of the New Zealand Police for use by CVIU Officers. It is available to the transport industry as a reference guide.
The Guide provides national enforcement guidelines that CVIU staff will apply nationally. It identifies a number of breaches that can place a driver or vehicle out of service.
The CVIU has endeavored to ensure the material in this document is technically accurate and reflects legal requirements. The document must be read in conjunction with relevant legislation.

OUT OF SERVICE OPTIONS
When placing a vehicle out of service you have three options:
1. Unsafe Vehicle (Pink Sticker)
Where you believe on reasonable grounds that a vehicle on a road is not in a safe condition to be driven on the road, issue a Pink Sticker under Section 115 (3) of the Land Transport Act 1998. ( A breach of this order is enforceable)
2. Vehicle that does not Comply with Regulations or Rules (Green Sticker)
Where you believe on reasonable grounds that a vehicle does not comply with the provisions of the regulations or the rules, issue a Green Sticker under Section 115 (1) of the Land Transport Act 1998. The vehicle may continue to be driven to reach a specified place for repair or may continue to be driven for a given time or under limitations as to speed or route or otherwise ( A breach of this order is enforceable)
3. Vehicle that does not Comply with Regulations or Rules (Verbal or Written Direction other than Green Sticker)
Where a minor defect is found that does not warrant the vehicle being inspected for a warrant of fitness or certificate of fitness, issue a verbal direction or a written direction on a TON to direct the vehicle to a place for repairs.

Maximum Penalty: Imprisonment for a term not exceeding 5 years and or a fine not exceeding $20,000.
and Disqualified for a minimum period of 1 year or more

EXCESS BREATH ALCOHOL CAUSING INJURY OR DEATH [A107] [A108]
|
Being in charge of a motor vehicle on a road caused bodily injury or death while breath alcohol exceeded 400 micrograms of alcohol per litre of breath.
|
Process suspect for Drink or Drugs.
Suspect may be arrested if necessary.
|
Maximum Penalty: Imprisonment for a term not exceeding 5 years and or a fine not exceeding $20,000.
and Disqualified for a minimum period of 1 year or more

DROVE UNDER THE INFLUENCE OF DRINK/DRUG OR BOTH [A109]
|
Drove a motor vehicle on a road while under the influence of drink or a drug or both to such an extent as to be incapable of proper control of the vehicle.
|
Process suspect for Drink or Drugs.
Suspect may be arrested if necessary.
|
Maximum Penalty: Imprisonment for a term not exceeding 3 months and or a fine not exceeding $4,500. and Disqualified for a minimum period of 6 months.
Note: If offence is third or subsequent qualifying offence , up to up to 2 years imprisonment and or the maximum fine and disqualified for minimum of one year.

UNDER INFLUENCE OF DRINK/DRUG CAUSING INJURY OR DEATH [A110] [A111]
|
Was in charge of a motor vehicle and caused bodily injury while under the influence of drink or a drug or both to such an extent as to have improper control of the vehicle.
|
Process suspect for Drink or Drugs.
Suspect may be arrested if necessary.
|
Maximum Penalty: Imprisonment for a term not exceeding 5 years and or a fine not exceeding $20,000.
and Disqualified for a period of 1 year or more

EXCESS BLOOD/BREATH ALCHOL CAUSING INJURY OR DEATH [A303] [A304]
|
Was in charge of a motor vehicle and caused bodily injury or death while the proportion of alcohol in the blood exceeded 80 milligrams of alcohol per 100 millilitres of blood.
|
Process suspect for Drink or Drugs.
Suspect may be arrested if necessary.
|
Maximum Penalty: Imprisonment for a term not exceeding 5 years and or a fine not exceeding $20,000.
and Disqualified for a period of 1 year or more

|
Refused or failed to accompany an enforcement officer to a place when required to do so.

A fine not exceeding $4,500. and Disqualified for such term as the court sees fit.
|
|
REFUSED OFFICERS REQUEST FOR BLOOD SPECIMEN [A309]
|
Refused or failed to permit a blood specimen to be taken after having been requested by an enforcement officer.
|
Charge suspect for the offence
Suspect may be arrested if necessary.
|
Maximum Penalty: Imprisonment for a term not exceeding 3 months and or a fine not exceeding $4,500. and Disqualified for a minimum period of 6 months.
Note If the offence is third or subsequent qualifying offence, imprisonment for a minimum period of 2 years, maximum $6000 and minimum period of disqualification for 1year.

REFUSED TO ACCOMPANY OFFICER TO ANOTHER PLACE FOR BLOOD TEST [A316]
|
Having accompanied an officer to a place, refused or failed to accompany an enforcement officer to another place when required to do so.
|
Process suspect for Drink or Drugs.
Suspect may be arrested if necessary.
|
Maximum Penalty: Imprisonment for a term not exceeding 3 months or a fine not exceeding $4,500. and Disqualified for a minimum period of 6 months.

|
FAILED TO REMAIN FOR RESULT OF BREATH SCREENING TEST [A317]
|
After under going a breath screening test refused or failed to remain at that place until after the result of the test was obtained.
|
Process suspect for Drink or Drugs.
Suspect may be arrested.
|
Maximum Penalty: a fine not exceeding $4,500. and Disqualified for such period as the court sees fit.
|
|
FAILED TO REMAIN FOR RESULT OF EVIDENTIAL BREATH TEST [A319]
|
After undergoing an evidential breath test refused or failed to remain at that place until the result of the test was obtained.
|
Process suspect for Drink or Drugs.
Suspect may be arrested if necessary.
|
Maximum Penalty: A fine not exceeding $4,500. and Disqualified for such period as the court sees fit.
Note For a third or subsequent qualifying offence, imprisonment for a maximum of 2 years and or a fine not exceeding $6,000 and disqualification for a minimum of 2 years.

|
Drove or attempted to drive a motor vehicle on a road while the proportion of alcohol in the blood exceeded 80 milligrams of alcohol per 100 millilitres of blood.

Suspect may be arrested if necessary.
|
Maximum Penalty: Imprisonment for a term not exceeding 3 months or a fine not exceeding $4,500. and disqualified for a minimum period of 6 months.

1. Only use if level is less than 80 mgs per 100 mls
2. If over 80 use A323 or A330
3. Maximum fine is $2250 & disqualification is 3 mths

BREATH ALCOHOL LEVEL OVER 400 MGMS/LITRE OF BREATH [A518]
|
Drove or attempted to drive a motor vehicle on a road while the proportion of alcohol in the breath exceeded 400 micrograms of alcohol per litre of breath.
|
Process suspect for Drink or Drugs.
Suspect may be arrested if necessary.
|
Maximum Penalty: A fine not exceeding $4,500. and Disqualified for such period as the court sees fit.
Note For a third or subsequent qualifying offence, imprisonment for a maximum of 2 years and or a fine not exceeding $6,000 and disqualification for a minimum of 2 years.

|
PERSON UNDER 20 EXCEEDED BREATH ALCOHOL LIMIT [A519]
|
Person under 20 years of age drove or attempted to drive a motor vehicle on a road while the proportion of alcohol in the breath exceeded 150 micrograms of alcohol per litre of breath. NOTE:
1. Only use if level is less than 400 mg/litre of breath
2. If over 400 use A518
3. Maximum fine is $2250 and disqualification is 3 months

|
Drove a vehicle or vehicles for more than a total period of 11 hours in any 24-hour period.

If the offence is "real time" place the driver out of service until the person has had the required rest break.

If the offence is "historical time" an offence notice may be issued
|
Driver: Maximum fine not exceeding $2,000 and Disqualification for a minimum of 1 calendar month or more as the Court sees fit.

|
DRIVER EXCEEDS 14 HOURS WORK IN 24 HOURS [M122]
|
Driver was worked or was On Duty for more than 14 hours in a 24-hour period.
|
If the offence is "real time" place the driver out of service until the person has had the required rest break.
An offence notice/s may be issued
If the offence is "historical time" an offence notice may be issued
|
Driver: Maximum fine not exceeding $2,000 and Disqualification for a minimum of 1 calendar month or more as the Court sees fit.
Any Other Case: Max fine not exceeding $10,000

DRIVER WORKS MORE THAN 70 HOURS WITHOUT 24 HOURS OFF [M126]
|
Driver worked for more than a total of 70 hours without having at least 24 consecutive hours off duty
|

If the offence is "historical time" an offence notice may be issued

Driver produced a logbook with false entries
|
An offence notice/s may be issued. The enforcement pages of the logbook may be taken.
Note: If there are multiple offences only one notice can be issued per logbook produced.
The summary of facts must indicate that the charge is a representative of other offences detected. These other offences must be identified in a schedule of offences in the summary of facts

Transporting DG’s when the packaging they were contained in was leaking.

The vehicle/s can move off once the DG’s are placed in a new leak-proof container and any spillage has been cleaned up.
Health Department may seize contaminated food related goods.
An offence notice/s may be issued to driver or operator.

- If the vehicle/s Certificate/s of Loading are endorsed, the infringement fees are based on a gross weight of 42,000kg. Can be issued notice for exceeding 19 metres.
- If the combination is a 4 axle truck towing either 3 axle or 4 axle trailer the infringement is based on 44,000kg provided the Certificate of Loading/s are endorsed and the combination complies with the NZHVMBC or 4011A.

CALCULATION OF HIONS PAYABLE
The current Police policy is a carry over of the old TSS policy, which was originally promulgated in section 3.8.21(6) of the Traffic Officer’s Manual.
Section 69B(3) of the Transport Act 1962 says:
"(3) For the purposes of this Act, separate overloading offences shall be deemed to be committed in respect of every axle, every group of axles of any heavy motor vehicle or combination of vehicles , the weight on which exceeds the maximum weight fixed by or pursuant to the relevant provision or prescribed limit."
While the legislation permits a separate infringement for all offences, this has always been considered unreasonable. A policy was therefore developed that meant that excluding gross weight, offenders do not have to pay more than once for any axle. Assuming that you have weighed the vehicle, measured the axle spacings, applied the tolerances and calculated the infringement fees, this is how the policy goes.
(To make the job easier the calculation sheet should be used.)
- Any fee calculated for gross weight is payable.
- Look down the fees in the "Fees calculated" column and choose the highest fee. If there are two or more fees the same choose the one that involves the least number of axles.
- Transfer this fee to the "Fees payable" column and cross it out in the "Fees calculated" column.
- Note the axle numbers which contributed to this fee and cross out any other rows where any of these axles were involved.
- Now choose the next highest fee left in the "Fees calculated" column, i.e. the highest fee that hasn’t been crossed out.
- Transfer this fee to the "Fees payable" column and cross it out in the "Fees calculated" column.
- Cross out all other rows which include any of the axles involved in this fee.
- Repeat steps (e), (f) and (g) until all fees in the "Fees calculated" column have been crossed out.
- HIONs can now be issued for the fees listed in the "Fees payable" column.
